Service Level Agreement (SLA)

1. Introduction

This Service Level Agreement ("SLA") describes the uptime commitments and service credit terms for Attested (the "Service"), operated by Verifore Technologies LLC, a Louisiana limited liability company. This SLA applies to all paid subscriptions and defines the service levels Subscribers can expect.

2. Uptime Commitment

Verifore Technologies LLC targets 99.5% monthly uptime for the Service, measured against the availability of the attested.legal application and dashboard. "Uptime" is calculated as the total minutes in a calendar month minus minutes of Unplanned Downtime, divided by the total minutes in the month.

3. Exclusions

The uptime target excludes downtime caused by:

• (a) Scheduled maintenance announced at least 24 hours in advance;
• (b) Outages caused by third-party infrastructure providers (Supabase, Vercel, Stripe, Anthropic, Resend);
• (c) Outages caused by Subscriber misconfiguration or unauthorized access;
• (d) Force majeure events (natural disasters, network outages beyond our control, acts of war, government action);
• (e) Beta features or features marked as experimental.

4. AI Features

AI Features (Counsel AI and Document Review) are dependent on Anthropic's API availability and are not subject to the uptime guarantee in this SLA. Verifore Technologies LLC will use commercially reasonable efforts to maintain availability of AI Features but makes no uptime commitment for these features.

5. Service Credits

In the event of an unplanned outage exceeding four (4) consecutive hours within a single billing cycle, Subscribers on paid tiers may request a service credit equal to one (1) day of subscription fees per hour of outage beyond the four-hour threshold, up to a maximum of seven (7) days of fees per billing cycle.

5.1 Credit Request Process:

• Credits must be requested within thirty (30) days of the incident
• Email anthony@attested.legal with details of the outage, including date, time, and duration
• Credits are applied to your next billing cycle invoice
• Credits are the exclusive remedy for SLA failures

• Status Updates: Email notifications for outages exceeding 30 minutes
• Post-Incident Reports: Provided to Enterprise Subscribers within 5 business days
• Root Cause Analysis: Available upon request for Enterprise tier

9. Severability

If any provision of this SLA is held to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

10. Governing Law

This SLA is governed by the laws of the State of Louisiana, without regard to conflict of laws principles. Any dispute arising from this SLA shall be brought exclusively in the state or federal courts located in Jefferson Parish, Louisiana.
