The following capitalized terms have the meanings set forth below when used in these Terms of Service:
These Terms of Service ("Terms") govern your use of the Service, operated by Verifore Technologies LLC, a Louisiana limited liability company ("Company," "we," "us," or "our").
By creating an account, accessing, or using the Service, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
The Service provides secure evidence sharing with cryptographic integrity verification, viewer identity watermarking, access audit trail documentation, and self-authenticating evidence Certificates. The Service is designed for legal professionals managing sensitive Evidence and media.
3.1 Core Features:
By default, files uploaded to the Service use Temporary Access with automatic expiration based on your selected duration (24 hours, 48 hours, or 7 days). Professional and Enterprise Subscribers may upload files as Preserved Evidence for permanent storage. After Temporary Access expiration, files are permanently deleted and cannot be recovered.
The Service includes optional automated document analysis features, including without limitation Counsel AI (an informational assistant available on the public website) and Document Review (an automated analysis tool available to Subscribers within the dashboard). These features process Subscriber Content using third-party large language model infrastructure provided by Anthropic, PBC ("Anthropic") under its commercial terms.
Subscriber acknowledges and agrees that:
To use the Service, you must create an account by providing a valid email address. You may register using:
You are responsible for maintaining the security of your account credentials. You must immediately notify us at anthony@attested.legal if you believe your account has been compromised. One account per individual; organizational accounts should use the Enterprise tier.
The Service is offered in three tiers: Essential (free), Professional ($199/month or $169/month billed annually), and Enterprise ($599/month or $499/month billed annually). Each tier includes monthly allowances for shares, Certificates, and Document Reviews as set forth on the Pricing page at attested.legal/pricing.
Annual billing: $2,028/year (save 15%). Per firm, not per seat.
Annual billing: $5,988/year (save 15%). Per firm, not per seat.
Usage in excess of monthly allowances is billed as overage at the rates published on the Pricing page. Overage charges accrue in real time and are invoiced through Stripe, Inc. ("Stripe") at the end of each billing cycle. Subscriber authorizes Verifore Technologies LLC to charge the payment method on file for all subscription fees and overage charges.
Overage charges are metered automatically and appear as a separate line item on your invoice. You can monitor your current usage from your dashboard billing page.
Verifore Technologies LLC reserves the right to modify pricing, allowances, and overage rates upon thirty (30) days' notice to Subscriber. Continued use of the Service after the effective date of any modification constitutes acceptance of the modified terms. All payments are processed securely through Stripe.
By default, files uploaded to the Service use Temporary Access with automatic expiration. When you upload a file, you select an expiration duration (24 hours, 48 hours, or 7 days). After this duration, the file is automatically and permanently deleted. Professional and Enterprise Subscribers may instead upload files as Preserved Evidence for permanent retention.
You may manually "shred" a file at any time before expiration. Shredding immediately and permanently destroys:
Shredded files cannot be recovered under any circumstances. Chain of custody Certificates generated before shredding remain available for download for 7 years.
Every video, image, or audio file viewed through the Service is watermarked with the viewer's verified email address via a visible overlay during playback. This watermarking is intentionally visible and serves as both a deterrent and an attribution mechanism.
Important Limitations: The Service's viewer identity watermarking provides viewer attribution for accountability and deterrence. It does not prevent screen capture or recording. If Evidence is leaked, the watermark identifies who viewed it but does not technically prevent the leak.
Watermark visibility may vary based on the viewer's device, screen settings, and recording method.
Every file upload generates a SHA-256 cryptographic hash that uniquely identifies the file's content. Any modification to the file would result in a different hash, providing cryptographic proof of integrity. Important: SHA-256 integrity verification proves file integrity from the point of upload. The Service cannot verify the integrity of files before they are uploaded to the platform.
Every file access is logged with:
FRE 902(13) self-authenticating evidence Certificates are available for Professional and Enterprise tiers. These Certificates compile the file's hash, upload record, and complete access log into an authentication document.
Important Disclaimer: FRE 902(13) Certificates support self-authentication but do not guarantee admissibility. Courts make admissibility determinations on a case-by-case basis. Subscribers should consult their own legal counsel regarding admissibility requirements in their jurisdiction.
10.1 Temporary Access Files:
10.2 Access Logs:
10.3 Certificates:
10.4 Account Data:
10.5 Stripe Billing Records: Retained per Stripe's data retention policies. We do not store credit card numbers.
The Service is intended for lawful evidence sharing by legal professionals, businesses, and organizations. See our Acceptable Use Policy for complete details.
Prohibited Uses include, without limitation:
Verifore Technologies LLC reserves the right to suspend or terminate accounts that violate these Terms. Severe violations (such as illegal Content) will be reported to law enforcement.
Paid subscriptions (Professional, Enterprise) are billed via Stripe on a monthly or annual basis. Annual billing provides a discount compared to monthly billing.
12.1 Failed Payments: If a payment fails, you will be notified via email. If payment is not resolved within 7 days, access to paid features will be restricted. After 30 days, your account will be suspended.
12.2 Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of your current billing period. You will retain access to paid features until the period ends.
12.3 Refunds: See our Refund Policy for details.
12.4 Stripe Tax: Applicable taxes are automatically calculated and applied at checkout based on your location.

This license terminates when you delete the Content or close your account, except to the extent necessary to comply with legal retention requirements (e.g., access logs retained for 7 years).
15.1 THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
15.2 Maximum Liability: TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, VERIFORE TECHNOLOGIES LLC'S TOTAL AGGREGATE LIABILITY FOR ANY AND ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE TOTAL SUBSCRIPTION FEES PAID BY SUBSCRIBER TO VERIFORE TECHNOLOGIES LLC DURING THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
15.3 Exclusion of Consequential Damages: IN NO EVENT SHALL VERIFORE TECHNOLOGIES LLC BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION LOSS OF PROFITS, DATA, USE, OR GOODWILL, REGARDLESS OF THE THEORY OF LIABILITY.
15.4 Carve-Outs: The limitations in Sections 15.2 and 15.3 shall not apply to liability arising from (a) gross negligence or willful misconduct by Verifore Technologies LLC, or (b) Verifore Technologies LLC's breach of its confidentiality obligations under these Terms.

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving the original intent of the parties.
These Terms are governed by the laws of the State of Louisiana, without regard to conflict of laws principles. Any dispute arising from or relating to these Terms or the Service shall be brought exclusively in the state or federal courts located in Jefferson Parish, Louisiana.
You consent to the exclusive jurisdiction and venue of these courts and waive any objection based on inconvenient forum.
